Prominent Lusaka lawyer Mr. Celestin Mukandila says the sale of Mopani Copper Mines to international Resources Holdings (IRH) was illegal because the due process of the law was not followed.
Speaking on Live Radio’s “State of the Nation “ program this morning Mr. Mukandila said the sale of public resources has a laid down procedure which should be followed,” article 200 and 10, sub article 2 of the Constitution of Zambia is extremely clear as to how state assets can be disposed off.
Article 200-10 sub article 2 states that, “ a major asset shall be sold, transferred or otherwise disposed off as prescribed; subject to the approval of the National Assembly, dignified by a vote of at least two thirds of members of parliament.” He said.
He added that Mopani was a subsidiary of ZCCM -IH , as of 2021 ZCCM- IH owned 100 per cent shareholding in mopani copper mines.
Mr. Mukandila further bemoaned the paying of $45m for debt restructuring advice to Lazard Frerres by the UPND government when President Hakainde Hichilema disagreed when the then Patriotic Front government wanted to pay the same service to Lazard Frerres at a fee of $5m
